The draft act on the electronicisation of deliveries was prepared by the Ministry of Digitization. Electronic delivery will be introduced initially as the default, and ultimately as the primary channel for exchanging correspondence, which requires the receipt or confirmation of posting to have specific legal effects.
E-delivery will be the equivalent of sending a traditional registered letter with acknowledgment of receipt or personal delivery. For the purpose of electronic delivery, a special public register will be created – the ‘electronic address database’. The public entity will be required to deliver letters to the address indicated therein. The electronic delivery service will be provided by the designated operator – Poczta Polska, as well as commercial suppliers.
The planned date of entry into force of the Act is the fourth quarter of 2020.
