The purpose of this Privacy Policy is to explain the rules governing the processing of personal data of the firm’s clients.

Personal data controller

The administrator of personal data is Tomczak i Partnerzy Spółka Adwokacka (“T&P”) with its registered office in Warsaw (00-252) at ul. Podwale 3/9. Personal data collected by T&P are processed on the terms set out in the provisions on the protection of personal data, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (General Data Protection Regulation) (“GDPR”) and in Polish regulations issued in connection with the GDPR, including the Act of May 10, 2018 on the protection of personal data. T&P keeps personal data confidential and protects them against unauthorized access by third parties on the terms set out in the above-mentioned legal acts.

The scope and purposes of personal data processing

As part of its activities, T&P collects and processes personal data:

  1. for purposes resulting from legitimate purposes pursued by T&P as a data controller: to provide services to customers, marketing T&P services, as well as for analytical and statistical purposes and to ensure ICT security related to the tomczak.pl website;
  2. in order to perform contracts concluded by T&P with clients, including organizing training courses, in order to cooperate with suppliers and other entities cooperating with T&P (Article 6 (1) (b) of the GDPR);
  3. in order to recruit people interested in working or cooperating with T&P (legal basis, respectively, Article 6 (1) (c) and Article 6 (1) (a) of the GDPR).

We also process personal data in the scope of fulfilling the legal obligations incumbent on T&P (legal basis: Article 6 (1) (c) of the GDPR).

Your rights

The processing of your personal data is carried out on a voluntary basis, however, depending on the circumstances, refusing to provide data or requesting its removal may prevent us from contacting you. The processing of personal data as part of the provision of legal assistance services is regulated in contracts concluded with clients or in the general terms and conditions regarding the provision of legal services. to the newsletter or by submitting an instruction to receive specific information, including thematic legal alerts. You have the right to access your personal data, the right to rectify it, delete or limit processing, and the right to transfer data. Some of these rights may not apply to data processing as part of the provision of legal assistance. You can object to the processing of your personal data for this purpose at any time. If you have given your consent to the processing of personal data, you can withdraw it at any time, however, the withdrawal of consent will not affect the processing of data that took place before its withdrawal.

Right to lodge a complaint

You have the right to lodge a complaint related to the processing of personal data by T&P to the President of the Personal Data Protection Office (until the date of entry into force of the Act of 10 May 2018 on the protection of personal data – to the Inspector General for Personal Data Protection).

Processing period

Personal data will be processed, as appropriate, until the relevant legitimate interests pursued by T&P as a data controller related to the processing of specific data are fulfilled, until the expiry of the limitation periods related to the contract with which the processing of personal data is related, or related to the statute of limitations of obligations arising from legal provisions, until an objection to processing for marketing purposes is raised.

Transferring personal data to other entities

The recipients of your personal data may be, in particular, entities directly or indirectly related to T&P, in particular in an organizational or personal manner, that would be based in one of the Member States of the European Union, as well as external accounting service providers, statutory auditors and auditors, lawyers, authorities administration, state services and courts.

Your personal data is processed at the headquarters of T&P. Personal data is not transferred to countries outside the European Union (without prior determination of the conditions for such processing). In the event of transfer of personal data to third countries outside the EU, T&P will apply appropriate instruments to ensure the security of your personal data.

Entities to whom T&P will provide data as part of the performance of contracts will be obliged to maintain the confidentiality of your personal data and to process them in accordance with the provisions on the protection of personal data and the relevant instructions of T&P.

No profiling

Your personal data is not subject to profiling as one of the forms of automated personal data processing.

Changes to the Privacy Policy

Any changes we introduce to the Privacy Policy in the future will be published on the website tomczak.pl, they will be valid only for the future and will come into force after accepting the modified privacy policy, about which you will be notified.
